Every person who, under color of any statute,
ordinance, regulation, custom, or usage, of any State or Territory or
the District of Columbia, subjects, or causes to be subjected, any
citizen of the United States or other person within the jurisdiction
thereof to the deprivation of any rights, privileges, or immunities
secured by the Constitution and laws, shall be liable to the party
injured in an action at law, suit in equity, or other proper proceeding
for redress, except that in any action brought against a judicial
officer for an act or omission taken in such officer's judicial
capacity, injunctive relief shall not be granted unless a declaratory
decree was violated or declaratory relief was unavailable. For the
purposes of this section, any Act of Congress applicable exclusively to
the District of Columbia shall be considered to be a statute of the
District of Columbia.

The No Kill Advocacy Center has become increasingly aware that some officials who oversee shelters are threatening volunteers and rescuers that if they speak publicly about conditions at the shelter, they will be banned from volunteering or rescuing animals. But in actually banning or threatening to ban volunteers and rescuers, these officials nationwide are not only holding the animals hostage by threatening to kill them as punishment, they are also violating the civil rights of volunteers.
In 2008, Los Angeles rescuers teamed up with the No Kill Advocacy Center to file a lawsuit which alleged that the civil rights of volunteers and rescuers were being violated as retaliation for going public with their observations of inhumane conditions and neglectful treatment at the shelter. The court agreed.
In applying a federal civil rights statute to this area, the court gave animal activists a powerful weapon to reform the nation's broken animal shelter system. Volunteers and rescuers no longer have to choose between remaining silent about abuses or risk losing their ability to help some animals by volunteering or rescuing them from death row.
Attorney Sheldon Eisenberg, who brought the ground-breaking lawsuit, argues that 'Section 1983,' which was enacted as part of the Ku Klux Klan Act of 1871 can now help extend the protection of laws to those individuals committed to safeguarding the welfare and rights of the animals entrusted to our care.

Public Law No: 109-308: Pets Evacuation and Transportation Standards Act of 2006

SECTION 1. SHORT TITLE.
This Act may be cited as the 'Pets Evacuation and Transportation Standards Act of 2006'.
SEC. 2. STANDARDS FOR STATE AND LOCAL EMERGENCY PREPAREDNESS OPERATIONAL PLANS.
Section 613 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5196b) is amended--
(1) by redesignating subsection (g) as subsection (h); and
(2) by inserting after subsection (f) the following:
(g) Standards for State and Local Emergency Preparedness Operational Plans- In approving standards for State and local emergency preparedness operational plans pursuant to subsection (b)(3), the Director shall ensure that such plans take into account the needs of individuals with household pets and service animals prior to, during, and following a major disaster or emergency.'.
SEC. 3. EMERGENCY PREPAREDNESS MEASURES OF THE DIRECTOR.
Section 611 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5196) is amended--
(1) in subsection (e)--
(A) in paragraph (2), by striking `and' at the end;
(B) in paragraph (3), by striking the period and inserting `; and'; and
(C) by adding at the end the following:
(4) plans that take into account the needs of individuals with pets and service animals prior to, during, and following a major disaster or emergency.'; and
(2) in subsection (j)--
(A) by redesignating paragraphs (2) through (8) as paragraphs (3) through (9), respectively; and
(B) by inserting after paragraph (1) the following:
(2) The Director may make financial contributions, on the basis of programs or projects approved by the Director, to the States and local authorities for animal emergency preparedness purposes, including the procurement, construction, leasing, or renovating of emergency shelter facilities and materials that will accommodate people with pets and service animals.'.
SEC. 4. PROVIDING ESSENTIAL ASSISTANCE TO INDIVIDUALS WITH HOUSEHOLD PETS AND SERVICE ANIMALS FOLLOWING A DISASTER.
Section 403(a)(3) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5170b(a)(3)) is amended--
(1) in subparagraph (H), by striking 'and' at the end;
(2) in subparagraph (I), by striking the period and inserting '; and'; and
(3) by adding at the end the following:
(J) provision of rescue, care, shelter, and essential needs--
(i) to individuals with household pets and service animals; and
(ii) to such pets and animals.

Kentucky pets continue to be shot by animal control officers at county shelters, and cats sold to laboratories. This is because the state gave control of county shelters over to county government officials, known as Judge Executives (they are not real judges, but elected business people in the 138 counties in the state, which are mostly rural and poverty stricken).
The state law enforcers are the local state police, who in turn, answer to local county officials also. So when these officials don't care about the animals, or dont want to spend any funds on them, the shelters are humane disasters, case in point the Ohio County shelter who many have accused of shooting dogs instead of spending the money on euthanasia injections. See the link below. Some counties even make money by selling the cat carcasseso labs and colleges, instead of trying to get cats adopted.

On or about November 4, 2009 in Owingsville, KY, a beautiful two year old Golden Retriever named "Dusty" was found hanging from a backhoe in a macabre display of brutality, visible to any who were unfortunate witnesses passing on a nearby road. The owner of the dog, Wesley Barrett, claims that his unnamed neighbor shot and killed the dog, upon finding the dog dead he hung the dog as a message to his neighbor. A shocked witness of the hanging dog took photos and called animal control. Police were notified and sent to the Barrett residence, however, Mr. Barrett failed to name the neighbor that allegedly shot the dog, he failed to press charges and the police did not nvestigate this gruesome murder.
According to many reports, an investigation into this murder has been requested, however, to date, the concern for Dusty's murder seems to have disappeared as quickly as his body. We call for an investigation into this senseless murder. We ask what pet owner would hang his dead dog and refuse to press charges against whoever allegedly murdered his dog?
We ask the officials of Kentucky to take a stand, do not let Dusty's murder go unpunished, this was blatant animal abuse and nothing less. Dusty was only 2 years old, I cannot imagine the pain this dog suffered prior to his death.
